Although it’s true that the FDA does not require nutraceutical manufacturers to verify the health claims on their product labels, one thing is clear: the FDA will take action against nutraceutical companies that claim to cure, treat, or mitigate any number of diseases.

The reason? Such a claim would designate dietary supplements as drugs and therefore, violate the articles of section 201(g)(1)(B) of the Federal Food, Drug, and Cosmetic Act (the Act) [21 U.S.C. § 321(g)(1)(B)]. Products may not be sold as drugs without prior approval from the FDA, as described in sections 301(d) and 505(a) of the Act [21 U.S.C. §§ 331(d), 355(a)].
